Divorce, Child Custody/Parenting Plan, Orders of Protection, Probate, Name Change

DIVORCE

If you are divorcing and have children there are four (4) aspects to a divorce that the family courts must address. If you are divorcing without children the latter two (2) on this list below must be addressed and adjudicated by the judge:

(1) Children: parenting time & decision-making

(2) Child support

(3) Division of property (all persons divorcing)

(4) Maintenance (all persons divorcing)

 

Divorce often means compromise, but this does not mean a difficult spouse should dictate the parenting schedule or how property such as retirement accounts, bank accounts, or equity from a marital home is divided.  I have experience working with self-representing parties as well as seasoned attorneys to achieve favorable outcomes for my clients.  The issue of maintenance (alimony) is complex.  I have worked with clients to make sure they are treated fairly when it comes to either paying or receiving maintenance.

CHILD CUSTODY

Child custody involves developing a parenting plan and determining child support. Navigating through the complex world of developing a parenting plan can feel daunting and exhausting.  Family Court judges encourage settlement, but this does not mean you should give into the demands of a difficult former partner.   I have worked with parents who face challenging work and personal life issues that make developing a parenting plan difficult.  Child custody and parenting time impact child support.  Don't be taken advantage of during this process. I have experience working with my clients to ensure they are not taken advantage of by an opportunistic spouse. 

 

ORDERS OF PROTECTION

A civil Order of Protection is needed when someone is a victim of abuse.  Abuse is experienced in various ways such physical abuse, harassment, or intimidation.  Protection from a current or former partner/spouse can be dangerous such as when a former partner calls you repeatedly and the calls are unwanted, repeatedly shows up at your work or calls you at work without justification, or if your ex is threatening you, your family or using 3rd parties to harass you.  An Order of Protection may be needed in these circumstances.  I have worked with clients who have needed protection.  I have also worked with clients who have been falsely accused.  Sometimes compromise is possible, but these cases can lead to a hearing involving witnesses and presenting evidence.  Do not risk defending yourself without the assistance of an attorney who has battled for clients and protected their rights.
